Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales without regard to its conflict of law provisions.

Payment

Furry Friends Fitness requires payment in advance before any sessions or services are provided. Payment can be made using a secure PayPal option for credit card, or online using direct deposit into the Furry Friends Fitness bank account. Funds must clear before any services or sessions take place. See the Refund Policy below.

Delivery of Physical Services

Physical Services – refers to any dog walking or activity that you pay Furry Friends Fitness to provide to you/your dog/s. Physical Services include, but are not limited to:

• Half hour or full hour solo activity/walking sessions.
• Half hour or full hour small group activity/walking sessions.
• Pick up and return of dogs to your home or agreed place (i.e. transport of your dogs to an approved dog access area such as a beach, park, or reserve).

Safety – while dogs are in our care and control, all reasonable precautions to prevent serious injury and/or death will be undertaken. Precautions include, but are not limited to:

• Appropriate tethering of dogs to anchor points or seat belt buckles while in transport.
• Driver care and attention to traffic and all applicable road rules, including never transporting dogs while under the influence of drugs and/or alcohol.
• An access ramp for dogs to use to enter the rear section of the vehicle will be used for all dogs weighing more than 15 kgs. This is a workplace health and safety provision for Furry Friends Fitness. It also allows for ease of access for dogs affected by arthritis or similar conditions that affect mobility – no jumping in or out of the vehicle is required.

**Under no circumstances will Furry Friends Fitness consider itself liable for injury or death of any animal in its care, and you indemnify Furry Friends Fitness against any claim, now or in the future. Furry Friends Fitness will uphold its Duty of Care under all circumstances.

***By using Furry Friends Fitness to provide enrichment and fitness activities for your dog/s, you agree that in the case of emergency/illness, you give permission for Furry Friends Fitness to transport your dog to the nearest available veterinary clinic for treatment, and that you will take responsibility for veterinary fees incurred on behalf of your dog/s (you may specify a financial limit with Furry Friends Fitness in advance if you wish). Furry Friends Fitness will contact you as soon as possible in order to receive additional instructions from you regarding the welfare and treatment of your dog/s.

Pet Minding

Furry Friends Fitness also offers pet minding services at the owners’ premises or home. Every care will be taken to safeguard pets, but Furry Friends Fitness will not be held responsible for any illness or possible death of any pet, understanding that underlying conditions, infections, and unpredictable pet behaviour that is not under the control of Furry Friends Fitness may occur, in spite of all precautions. For example, a fish may jump out of a tank and die in between home visits by Furry Friends Fitness – not a situation that Furry Friends Fitness can have any control over.

Cancellation/Postponement & Refund Policy

Occasionally, Furry Friends Fitness may need to cancel or postpone a dog walking and enrichment session that you have booked and paid for. This will usually be due to unforeseen circumstances such as severe inclement weather, or illness of a Furry Friends Fitness worker. Should a necessary cancellation/postponement take place, Furry Friends Fitness will attempt to contact you as soon as a need to cancel/postpone is identified. You will be offered the opportunity to book for another occasion, or a full refund (less a $5 administration fee).

Should you cancel a session, you must contact Furry Friends Fitness as soon as possible to reschedule your session. A refund will only be possible for extenuating circumstances.

If you have booked and paid for multiple sessions (e.g., a regular weekly visit over several months), you will be eligible for a pro-rata refund amount of the unused portion of your booking (less a $5 administration fee).

Pet minding must take place on the days agreed, as to neglect a pet while an owner is away is unacceptable as food and water are essential daily needs. Should the usual Furry Friends Fitness worker be unable to attend, the business owner’s partner or an adult from the owner’s family will attend to care for your pet/s.

If you return earlier than your planned date for services to cease, you will be eligible for a pro-rata refund, less a $5 administration fee.

***By using Furry Friends Fitness to provide pet minding services in your home/premises, you agree that in the case of emergency/illness, you give permission for Furry Friends Fitness to transport your pet/s to the nearest available veterinary clinic for treatment, and that you will take responsibility for veterinary fees incurred on behalf of your pet/s (you may specify a financial limit with Furry Friends Fitness in advance if you wish). Furry Friends Fitness will contact you as soon as possible in order to receive additional instructions from you regarding the welfare and treatment of your pet/s.
